Some are remedial but I also have to remember that many have been trained as activists hell bent on dismantling or crippling the systems in place to seize power by any means.

Here is another clip from today in case you were wondering where Kagan stands. Claiming that the President will have unchecked power etc

Yes, they have and Ben Sasse used to give eloquent speeches on the Senate Floor on this subject. Kagan's argument seems to be that these alphabet agencies are more of an extension of the Legislative Branch given the fact they enact and adjudicate rules.

Think of the insanity we shouldn’t have an elected monarchy. We should have an appointed monarchy running key areas of the government. Unelected monarchy that is answerable to no one not even the president who is answerable to the people the United States.
