Sure, jury is deadlocked….now what?

Do you think the Bucs have a good chance at winning the Super Bowl this season?

Don't watch the NFL, next.

Rittenhouse is either acquitted, or the Judge throws out a guilty verdict. In his mind, the case has been made, and he has no doubt.
He's simply hoping at this point that the jury will do their job.
What about in the case of a hung jury?
If he rules a mistrial, there's a good (<99%) chance the case is retried.
I think he is sitting on the option of ruling Judgement Notwithstanding the Verdict, in the event of a Guilty verdict. I also think he is strongly considering charges of Prosecutorial Misconduct.
I think he wants the jury to come back with the only reasonable verdict (not guilty, by overwhelming lack of evidence), so that Rittenhouse is then free and clear of double jeopardy.
If we see an acquittal, we also might see just a tongue-lashing by the judge. If we see anything else, we're probably seeing formal actions taken against both Binger and Krause.

Folks in Kenosha are reporting pallets of bricks are dropped all over town.

If this were actually a free country, anything short of a unanimous jury verdict would be an acquittal. The state should not get another bite at the apple, especially if 10 of the 12 vote to acquit.

quote:Either a mistrial with or without prejudice. With and Kyle goes free. Without and they do this over again, with the same prosecutors. In such a case, however, the prosecution can't do anything new. The defense, who has seen their whole case, can alter their approach as they see fit.
Sure, jury is deadlocked….now what?
If it's without, Kyle might get new lawyers, ones with experience in retrials.

Are you sure? Reckieta crew said today they can call new witnesses.

Judgement Notwithstanding the Verdict,
This is a civil procedure that I can't find in the criminal section of Wisconsin code.
Do you have a link to the criminal procedure in Wisconsin statute that allows the judge to change a guilty verdict of a jury?

It doesn't matter. He is not doing that. He will accept the verdict or call a mistrial.

Yes.
But it will never happen. Especially with this judge.

Cops report finding bricks and dispatch notifies of at least 3 other reported locations.

Should jury deliberation audio be available to the public? To me that would make for great listening.

Still not getting it. Kyle had every right to walk down the street with a rifle, that doesn’t make it wise.

I don’t know that I’d use wise, I just think that you have to understand what could potentially happen to you by being there. There’s a lot of potential for stuff to go sideways (which it did for Kyle) and every word, movement, action is going to be scrutinized with a fine toothed comb. With that said, hats off to Kyle, he has more stones than most men.
It’s absolutely unfortunate that he could get railroaded in which is a pretty clear cut self defense case IMO.
Another question is why did they do all the cases at once instead of doing trial for each person that was shot?
