The potential witness disqualification can also be vexing. There will be plenty of persons who are public figures ( but not necessarily public officials if you even want to deal with that logic trap) called to testify against Trump. They even make statements on the record denouncing Trump tgat will get press coverage. Trump will only have narrow room to respond to those statements

I think limiting threats is reasonable, but character attacks may be rude but rarely dangerous. I don’t think calling Smith a “thug” is polite, but I don’t see it as dangerous or intimidating. If Trump loyalists were to be motivated to improper action is “thug” any more a call to action than “politically motivated” (which is allowed$

I can see that. I just agreed that it wasn't unreasonable; that's not an endorsement. You make a good point, and I think public figures, witnesses or not, give up certain protections that might should be offered to some accountant that saw his books.

This whole gag orders stuff needs to be taken to the Supreme Court. It is a violation of the 1st Amendment and needs to end.

Curious, could this gag order sidetrack the whole Jack Smith trial schedule if Trump attorneys appealed the gag ruling all the way to SCOTUS? It seems like would since it prevents Trump from defending himself 8n public while the prosecution leaks information to the media.

The problem is you probably still believe the DOJ and the federal judiciary are unbiased and above politics. They aren't. This judge was appointed by Obama. I think Trump secretly want the Judge to put him in Jail for violating the gag order because it will only further strengthen his position going into the election.

Per existing case law, you can’t punish someone for speech made from the floor of Congress.

This is a major problem in the criminal justice system. An indictment, which can be completely fabricated, puts you under the "supervision" of the government. Yet we criticize when violent criminals get let out prior to trial and hurt others. This is an issue we're going to have to wrestle with. In this case though, we're only talking about his words and I don't see a legit reason to shut people up no matter how big or small their megaphone might be.

I think he does and I think the Constitution says that as well.

I'm not sure why we think it's acceptable for the government to yank away someone's freedom so easily. Also not sure why Trump's attorney is agreeing with the judge. They should be testing the constitutionality of this and fighting for his rights.

My understanding is that the overwhelming majority of federal indictments end up pleading guilty or being found guilty. Even if you only look at the ones that don't plead out and go all the way to trial, roughly 95% get found guilty.

This idea that federal indictments are just thrown around willy nilly is a political talking point.

This is nothing like a normal federal case. In fact, Jack Smith has gone after a political opponent in the past and was slapped down 9-0 by the Supreme Court and admonished for his actions. If you want to look at precedent, that beat down is much more on point.

That’s not what I said. I said it is very easy to get an indictment. That is just a fact. If the prosecutor wants a true bill they will get a true bill.
