Depends on which agency’s definition. No water way in Texas with a similar flow, crossing private lands would be considered navigable by the DNR for kayak fishing purposes.

Thus, state governments do not have authority to act inconsistently (vis-a-vis foreign policy) with the federal government ... no matter HOW MUCH the state does not LIKE the federal policy. Yes, like it or not, "inaction" IS a policy.
This is Constitutional Federalism. Of course, the problem is that states are constantly being beaten back "into their lane," while the feds are constantly widening their lane ... but that is a different issue.
