The judge has already stated that the prosecution decided on indictment before presenting the case to the grand jury

" an indictment looking for a crime" may have been the actual wording.

The judge, thankfully, appears intent on doing the right thing ...
All of these things are acceptable only if you are pursuing Donald Trump and his administration.

Or is it only wrong if it's done to Trump?

If I am reading this correctly, and there is a good chance I am not, then Halligan could be in serious trouble. Because it looks like there is a chance that the GJ never approved the indictment.

Is that a fair reading?

That is diabarrment level activity.

Nope. In those cases they at least had a prima facia case.

bullshite. The legislature literally had to change the SOL so that the AG who literally ran on “get Trump” could go after him.

Then she charged him with fraud for a loan application in which the judgment said MAL was worth something stupid, like 18MM. Even the “victim” testified on Trump’s behalf. You’re a complete moron or a completely dishonest a-hole. Your choice.

I don’t have much sympathy for anyone who complains about lawfare after what has occurred over the past eight plus years.

It appears that, the argument at least, is they were using older evidence, generally, in later proceedings, in a bait and switch.

Like evidence from improper warrants from older cases, then after new subpoenas, claiming it was from the "Clean" new subpoena...same with GJ findings from the failed GJ projected onto the later attempt. It's very confusing and I can see why the judge is looking into it.

It could just be such sloppy work (due to being rushed) it's more embarrassing or unintentional.

Should be getting a ruling on that next week. I dunno how I feel about that though I was planning on continued entertainment from this case at least into January.

I have sympathy for Halligan. It was malpractice from main Justice to let her handle this indictment on her own, considering that she had ZERO federal criminal law experience. Is it possible that she acted without Bondi's input?

As bad as the Comey case has been botched, I think Halligan (and/or whoever helped her) did a good job with the James case.

Where did I say it was justified for someone to do the same thing that happened to Trump?

Light work.

How anyone could complain about grand jury proceedings after what was done to Donald Trump has no sympathy from me. The Left only underststands one thing.

Force.

but the GA case isn't a good example. GA even had some of the underlying predicate felonies for the RICO case.

The Georgia case is possibly the worst one IMO. Anyone that has read the entire transcript of the call can not come away from it thinking Trump was asking or doing anything nefarious.

I have wasted enough space and incurred enough hate already in explaining legally that there's little chance of this flimsy case making it to trial...and ZERO chance of there being a conviction.

Knock yourselves out in believing the legal grifters (superseding indictment!), but you can save lots of time and just accept that Comey will skate on THESE charges.

Yup.

I was kinda of hoping that this would go to trial so the public could see how pathetic the case was. Now they will just spend a few days screeching "Obama Judge!" and then move on to the next clickbait stunt.

The call is like 1% of the totality of that case. The call is just a piece of potential circumstantial evidence of the conspiracy and nowhere near important enough to damage the case without using it.

We can all read his testimony (even you can read it). It is crystal clear he made false statements

In a just and perfect system, Comey would be convicted of sedition. This particular case, unfortunately, boils down to was Comey lying in 2020 when he said "I stand by my" 2017 testimony?

"Standing by" doesn't mean "what I said was true." It means I'm sticking with my original story. So, even if the 2017 testimony was a lie (unfortunately, the statute of limitations has expired on that), what Comey said in 2020 was factually true.

This case has NO chance of ending in a conviction.

Meh. A magistrate ruling will just be appealed to the district court.

Who's COMPLAINING about grand jury proceedings? It's like arithmetic. 2 + 2 = 4, always! What Halligan did was the equivalent of 2 + 2 = Nebraska.

Of course Trump has been the victim of outrageous lawfare. That doesn’t change the Federal Rules of Criminal Procedure.

Are you saying Comey did not make false statements to Congress? Yikes dude. This case appears to be botched on procedural issues….not substantive. Your take is amazing. Not the greatest legal scholar are you?

Its a magistrate. Not appointed by a president. Dummy.
