In addition to the alleged burden shifting, the magistrate suggests that Halligan used the “just trust me bro” argument to suggest there was more evidence than what was presented (p.16 of the magistrate’s decision)

This.

And possibly you missed Patel's interview where he spoke about this case. That had to piss them off, making the case not as airtight as he bragged about.

Patel spoke about Comey's case as in LOOK WHAT THE FBI DID. While ducking calling J13 no there, there.

Nope. In those cases they at least had a prima facia case.

In any event that wouldn't justify the Comey farce.

I think Haligan is a fine attorney but throwing in someone with no experience on such a tight timeline will probably be looked back on as a mistake.

Maybe in the DC case, but the GA case isn't a good example. GA even had some of the underlying predicate felonies for the RICO case.

The problem with the NY case is the statute being so vague it covers so much behavior.

Florida is a mixed bag, with the classified documents case looking solid IF he did not declassify them properly, but the obstruction-related crimes were very solid.

This is due to a procedural flaw.

However, it isn't that different, as the Florida case was attacked for the prosecutor's purported ineligibility, too. The GA case is currently stayed due to Fanni's stupidity as well.

So it's not really different from the cases presenting the same potential procedural flaw.

That’s not even getting to the stale warrants, testifying agent may have testified to conversations protected by AC privilege, etc.

Even in GA, the investigation was started in search of a crime, though they had a charge early in the investigation.

I just think it is so weird to investigate in search of a crime, instead of investigating a crime, in search of a guilty party.

Just scummy.
