I don't have an answer for why to be honest - people have come up with lots of reasons over the years.
But the private model works in the US because US graduates are incredibly loyal to their schools.
US private schools tend to have really wealthy alumni who practically bankroll university operations instead of being beholden to government. Elite schools tend to be pretty loyal to their alumni in the US as well - it's why they're pretty much in the position they're in today where they're trying to keep both alumni and current students happy and failing to do so.
So you could argue that US schools produce really successful people or the US economy is that much stronger that it's able to produce that many successful people etc or really loyal alumni.
I'm sure most European schools would like to go private if they could afford it. But there's no such alumni loyalty that exists on the continent.

Yeah, I agree with your post and it reminds me of a conversation I had with a young German exchange student. It was back around 2000 and he wanted to get his premed degree and become a doctor in the U.S. if he could become an immigrant.
I asked him why he didn't go to college in Germany. He explained that every college in Germany is 'average.'
Me: 'How do Germans determine which school to attend?'
Him: 'They pick the town they like best. The colleges are the same.'

UVA law is very pretentious.
I can't stand their undergrad alumni. A high school acquaintance visited me in school and went to some of my second week survey-level classes and kept moaning about how easy it was compared to UVA.
We should never let them in our conference. Their football program has a ceiling that is lower than VA Tech.

No Im saying that going to an Ivy League school doesnt make you a good or bad judge. Hell I think we should have less Ivy League Justices. Justices should better reflect the public as a whole and like .4% of Americans went to an Ivy League school

One other little tid-bit. When I was researching, and being lazy, I asked ChatGPT where those four went to law school. Our friendly bot wouldn't tell me. She said I could find that information on the Colorado Supreme Court website.
