What some other judge does under another set of facts and circumstances and my opinion (and yours) of same is not really germane to the thread.
There will be plenty of other chances to try the “gotcha” on me. This one is a stretch. Just a pro-tip going forward… never piggyback off Rohan. Dude kicks puppies and has real issues.

Not really. I care because it’s an interesting wrinkle in a long-running topic on this board.
The phrase “judicial activism” is largely meaningless in the big scheme of things. There’s so much gray in the law that it’s really just the whining of the loser of the issue. There’s no objective truth in the law.

I actually enjoy your posts, particularly the 11th circuit.
I went down that rabbit hole the other day. The 11th is a 7-5 split favoring republicans but it's assigned, on appeal, randomly. I'm curious if they'll grant an emergency stay after the possible quilty verdicts. If they don't, the bad guys go to jail during the appeal process. If they do, could be dragged out into the next admin.
Should be a good show
I personally, as you know, want Brennan and all the others to rot in a jail cell or whatever club fed they give them.
But.....
Just to refresh, they threw Papadopoulos in a club fed for a month because he didn't recall a date on a calendar. That was his charge.
I wish for nothing but bad news for those evil, evil people.

Both her and Clarence Thomas did not believe Jack Smith had a legal right to hold his position because he was never appointed by congress. Anything he did in that position should be suspect and she treated it as such.

There is no "gray area" here, unless the Fruit of the Poisonous Tree doctrine has mystically disappeared from the legal realm.
You are suggesting that following the law constitutes activism, whereas not doing so would represent judicial conservatism.

Sure there is
The only appellate court to rule on the issue ruled the opposite a while back.
The admin dismissed the cases against the co Defendants before the 11th circuit could rule for a reason. They didn't want another appellate court to join in with the DC court of appeals
Many other district courts have ruled the same as the DC COA
Cannon is the minority view
