Interesting situation down in Ft. Pierce

You’ll recall Aileen Cannon issued a gag order over certain portions of Jack Smith’s report. Totally normal, not judicial activism at all.
Well some of the FBI agents involved in securing the warrant and in the raid have been subpoenaed to testify in front of the GTOE grand jury. But they’re under a gag order from material witness Aileen Cannon!
So their lawyer had to motion Judge Cannon to get clarification on whether they can testify. Here’s a snippet of the motion:

The search warrant was already literally litigated in front of Cannon
This makes Cannon part of the conspiracy at the heart of the GTOE

Would Judge Cannon be obstructing the grand jury by not letting these agents testify?
Should she have to recuse on this motion in light of that possibility and her being a material witness in the underlying sequence of events?

Lots of people who claim to like to ask questions are noticeably absent, I imagine because the sources of their talking points haven't told them what to think/repeat.

The obstruction case was strong based on the indictment. The documents case was mid.
The pertinent question is if it was legal, both for the MAL case itself and the GTOE, however.

This is kind of the problem with the GTOE. At some point evidence against one piece of it has to shrink the theory instead of just adding another person to it.

And let’s just say someone is indicted and MAL raid is a part of the conspiracy… doesn’t the government have to turn over Jack Smith’s report under its Brady obligation?

heh. The moment DOJ actually charges someone with making the MAL investigation part of an unlawful conspiracy, the evidentiary record created by Smith's people DOJ's now prosecuting as conspiracy may become a source of required defense evidence and this exits endless narrative speculation and enters real-world adversarial evidence process which works by a different set of rules. ETA: and of course, evidence of Trump's alleged conduct potentially gets made public. and then we get into redaction battles, right?.

I’m glad you acknowledge it’s judicial activism. It’s up on appeal to the 11th. There’s not much for me to “address”.
