It is easily conceivable for a government to have little to no interference in the daily lives of a populace, yet reserving the meting of punishment on behalf of its citizens; capital punishment among its options.

The PA gives the Executive sole authority to determine who is a terrorist - with no recourse by the accused. It would be a small step to make terrorism itself a capital offense.

What's to stop the Executive from declaring political opponents "terrorists", and having them eliminated?

It's putting the ultimate power in the fallible government's hands.
