Diat,

I think this boils down to the fairness doctrine that our HR department so often reminds me of. A company probably can't make vaccination mandatory for 1099's if they aren't for their W2's and vice versa.

Forcing someone to take a emergency vaccine seems like a key indicator that the company is acting like an employer and not a 1099 relationship.

This is the concern, and they don't give a shite it seems. They have been piecemealing crap to us in company wide emails since last spring.

One example was buried deep in one of JBE's memo proclamations last summer was that an employee had to notify their direct sup the second they crossed state lines and returning from a vacay even that happened to fall on a weekend.

They referenced or inferred it in the blast email as an actual order of JBE, when in fact it was copy, pasted and lifted from a suggestive memo. That's the kind of crap we've had to endure and it's only getting worse.

Would you actually be eligible if that happens?

Lawyer up. I suspect there will be a new wave of 'car wreck' litigators, who'll focus on job-based discrimination.

You can try, but don’t count on it.

At will employment, so the employer can terminate you for any reason, but they’d not allowed to create a hostile work environment or abuse you.

Most people are ignorant when it comes to the law.

Your company provides health insurance, and the more people that need to use the HI the more the rates go up for everyone, company wide.

If they are all vaccinated why do they need you to get the shot? Won’t they be fine?

You do know that vaccines aren't 100% effective, don't you?

Thats why a lot of companies, ours included, have major fitness initiatives and fitness incentives for employees.

HR, Accounting, Legal, etc... All non-revenue producing departments are an overhead expense.

We're a big company (20+ Billion), so the cost of adding a couple of people to the HR department to manage COVID issues, is a minuscule drop in the bucket from a cost standpoint. Your comment is probably very true for smaller companies.

You could try this and it might be your best bet. Just start screaming HIPPA!

HIPPA doesn't apply to companies asking employees for their vaccine status.

The official word on these vaccines that I have seen published over and over again and as recently as just yesterday is that they are almost 100% effective. And almost 100% effective at PREVENTING SOMEONE FROM GETTING THE VIRUS, not just mitigating the symptoms when they get it. 95% is damn close for a vaccine to be able to do that.

I don't really believe that, but the point is that neither do you, really. Because that's about as close to bulletproof as I have ever seen on something like this.

This is just the left trying to have it both ways again, just like they did masks. Masks were either the sole reason 10 million people didn't die in America or (lack of wearing them) was the reason we couldn't flatten the curve in just two weeks, like they started out saying.

This is the same way. Depending upon the intent of the conversation vaccines are either 95% effective or not really that effective at all.

0% chance of Reddit cause it's 4chan. Having said that, if an employer wants to open themselves up to dictate health care compliance for one communicable disease, why not all the others? It is a slippery slope and one that most compliance departments will not want to go down.
