Justice Blackmun purported to find the constitutional right to abortion in the 14th Amendment, which says that no state can “deprive any person of life, liberty, or property, without due process of law.” How does this support aborting a fetus? No explanation has ever been given

Also, Blackmun used Constitutional clauses referring to "prenatal application" to support his reasoning for denying the rights of the unborn. Yep, he used the requirement that a person be 35 years old to run for president

Shortly after it came down, Harvard Law School professor John Hart Ely, a supporter of legalized abortion, wrote that “Roe is bad because it is bad constitutional law, or rather because it is not constitutional law and gives almost no sense of an obligation to try to be.”

“Justice Blackmun’s opinion provides essentially no reasoning in support of its holding,” a former Blackmun clerk, Edward Lazarus, has written. “And in the almost 30 years since Roe’s announcement, no one has produced a convincing defense of Roe on its own terms.”

My hope is that the Supremes make it a decision for each state to undertake.

Alabama will not kill babies
California will kill babies

Hopefully the people in Alabama who want to murder their babies will move to California. And hopefully they will stay there.

That’s a stretch. The only way you get there is if you take the evolving constitutionalist approach that the liberal Justices took in Roe and “read in” a right to privacy that includes the right to have an abortion.

Under current case law, the right exists, but that is still well-beyond being settled by the legal field. The right is far from being an enumerated one that is specifically mentioned as you imply it being.

In Federalist No. 46, Madison wrote how a federal army could be kept in check by state militias, "a standing army ... would be opposed [by] a militia." I read that twice and am still not sure what you are trying to get to... Are you worried a blue state will pass a gun ban or registry and somehow try to get the second amendment - which is expressly in the constitution - declared unconstitutional?

Each party is extremely shortsighted at times, opening cans of worms that could be used against their own arguments.

I really don't understand why Repubs are fighting for this so hard. I really don't care if someone makes the choice to have an abortion. One less possible welfare recipient, one less possible criminal, one less mouth to feed.

We used to have wars and diseases to take care of overpopulation. Now we are ensuring it.
