They are. That's what makes them "subject to the jurisdiction of the United States". If they weren't subject to that jurisdiction, then the US couldn't charge them with a crime or even deport them.
If that was the case in practice, then birthright citizenship wouldn't even be a thing. We'd just deport illegals along with the babies they had while they were here illegally and be done with it. Hopefully the SC ends this insane loophole.

That's not what "subject to the jurisdiction of" means, ketanji.

Countries who offer birthright citizenship

quote:

Antigua and Barbuda, Argentina, Barbados, Belize, Bolivia, Brazil, Canada, Chile, Costa Rica, Dominica, Ecuador, El Salvador, Grenada, Guatemala, Guyana, Honduras, Jamaica, Mexico, Panama, Paraguay, Peru, St. Kitts and Nevis, St. Lucia, St. Vincent and the Grenadines, Trinidad and Tobago, United States, Uruguay, Venezuela, Lesotho, Pakistan, Tanzania, Tuvalu

How many of those countries would you want to live in?

Notice no country in Europe or East Asia has unrestricted birthright citizenship.

We are so god damn dumb for still offering this in 2026. We should have ended it around 1950.

If they can’t or won’t eliminate it could they at least make a change.

Kid gets citizenship but has to go back with its parents to their country. They can return when they’re 18.

Dems will block anything suggested.

Alito is absolutely correct here. This incentivizes what these people are doing and you cannot argue that this was the founder's intent.

He's doing one better. Using it to show that a Mexican illegal is able to make citizenship decisions that are supposed to be controlled by us.
