That was a big part of the discussion prior to bringing in the jury yesterday, and the defense wanted Smith’s testimony to discuss FECA violations
In total, the state charged 34 counts of 175.10, and advanced four theories for a predicate crime: FECA, Tax fraud, 175.05 crimes ( misdemeanor business record violations) by AMI and Cohen, and the one that seems to be the main focus, New York Election law (17-152). Lawfaremedia has a good overview of each
Yesterday Bove and Blanche did ask for some clarification on the instructions for the predicate. That request was pushed to the charging conference

Thanks for posting that. So nowhere in the indictment or charging documents was trump accused of those alleged intended crimes, but it was simply in the opposition to a motion to dismiss? And no evidence was submitted in the trial to substantiate those allegations?
ETA: Man that article is crazy informative. The fourth allegation is a bootstrap that is meaningless. It requires “trying to influence elections by unlawful means”. Haha. That just brings us back to the other 3. Cohen’s testimony blows up the “he paid cohen double so he could label it a business expense” because cohen admitted to stealing the excess.
The other: one is a federal statute that a state court has zero jurisdiction over and the other is blaming trump for the actions of an unrelated third party.
AND….none of these were litigated. Simply mentioned in an opposition.
