This was an incredibly stupid move. This wasn’t some small hick town where you could phone your uncle who’s buddies with the sherif and have a speeding ticket dismissed. This was a super high profile case that got tons of media attention because of the person involved and the claims he made. You can’t be dumb enough to make this kind of move and believe people will just let it go. Announcing that you are dropping all charges because of his previous community service is beyond laughable especially after a grand jury indicted him on 16 felony counts.

It smells of a criminal conspiracy to obstruct justice. On one hand you have a grand jury who felt the evidence was strong enough to indict on 16 (that’s is sixteen) felony counts and on the other hand you have friends and other high profile persons reaching out to/ coordinating with the state AG on the defendants behalf to escape justice. Foxx certainly can’t claim that they reached a plea agreement either. She just had the charges dropped and his record expunged. She was clearly working on Smollet’s behalf and not representing the interests of the people of Chicago or Illinois.

The simple fact that Rahm Emanuel who is one of the most liberal politicians in the country is livid over this tells the American public that something truly evil went on behind the scenes.
This was a massive cover up and the people responsible along with Smollett should spend years in prison for it.

I think you’d probably have to remove Foxx as AG and potentially charge her to start. Secondly I’d think you’d have to move to have the deal nullified in some way because it is the result of an illegal activity involving the AG and the defendant and or associates of the defendant. In other words, was the deal reached in good faith or was it the result of a conspiracy to obstruct justice. I’m certainly not a lawyer though so I don’t know, but those text messages that are being leaked are not good for the AG or Smollet. She certainly angered some very powerful people in Chicago though.

He would still have to enter a plea agreement where in exchange for his testimony and cooperation he would receive X. There is none of that here. The AG simply dropped the charges, but she dropped them after coordinating with representatives of Smollet. She was clearly acting on behalf of Jussie and not the state. The texts prove it.

Not that any of us think it would happen, but technically the state can refile charges at any point within the statute of limitations (prescriptive period as we call it in Louisiana) UNLESS the matter was dismissed "with prejudice" which I havent seen specified. Leads me to believe without prejudice which allows refiling.

IMHO, the reason for this was to seal the records. They couldn't let this go to trial. Evidence would become public. Text messages between Jussie and Kamala Harris or something similar. That absolutely, positively, couldn't get out. The only option was to shut it down and hide the evidence. This wasn't just done for Jussie's personal benefit.
