Interesting situations about to unfurl here. A Special Prosecutor is the obvious answer, however with the political hack Garland solely responsible for making that decision, and his refusal to do so has House Republicans frothing at the mouth for an Impeachment Inquiry, and Biden's own DOJ and their sweetheart plea deal, may have handed them that Inquiry on a silver platter.

The Judge did not accept the revised plea deal.
"US District Judge Maryellen Noreika said she was not ready to accept the plea deal, and the hearing ended with Hunter Biden pleading not guilty for the time being.
The judge asked the sides to file additional briefs explaining the plea deal’s legal structuring."

As solely a MSNBC viewer, that is complete news to me. Didn't even know he had anything to plea to. But, I just saw a breaking update on something about the January 6 Insurrection Against our Fragile Democracy. Looking forward to some more journalism in that regard. Has me on the edge of my seat worrying about democracy.
