Basically, are you for or against cops busting up into your house without presenting themselves.

Louisville, KY officially bans no-knock warrants...

quote:

All 26 members of the Louisville Metro Council voted on Thursday to pass a ban on no-knock warrants, a measure known as “Breonna’s Law,” named after the former EMT who died in a police raid at her apartment.

Against. There's always a way to get your person.

I read a story years ago about a no knock on an Oregon family.

Wrong house....they had a mentally handicapped young girl and her family in their underwear outside in the rain while they ransacked the house.

Against, for narcotics and non violent felonies.

With the climate of race relations after the Summer of ‘16, we haven’t used them much. SWAT teams shouldn’t be blowing and going right now. Approach the targets heavy/with an obvious presence, breach the door, and loud call all contacts to exit.

If anyone chooses to remain inside the target, transition to treat the subject as a barricaded subject and introduce chemical less lethal to encourage a peaceful exit.

No-knock for narcotics is asking for trouble. If preservation of evidence is the concern, your case isn’t strong enough yet to warrant the execution of a the search/arrest warrant.

But let me be clear that they should not be completely banned. There are instances where the element of surprise is needed in order to save the lives of additional occupants and or keep the suspect from engaging officers and ultimately injuring or killing law enforcement or themselves.

Definitely Against

No Knock Warrants are for the most part dangerous as hell for both the Police and the Occupants.

While there may be certain circumstances where it’s needed, most of them should be disallowed.

So still basically a no knock.

So If the Government is granted a search warrant by a Judge, you think law enforcement should wait till they receive an answer to execute it? For evidence used in a narcotics case for example.

You can’t be this naive.

ETA: Obvious presence is meant to also include announcing police with a search warrant as well before knocking. Wasn’t in the original post, added to avoid confusion.

Against in any drug or non-violent cases. Reserved for only the most dangerous violent offenders and a judge should have to sign off on a no-knock being permissible in those cases

No knock warrants should be reserved for the most extreme circumstances (Hostage situation, terror suspect, charged with murder or worse) and require two separate judges to sign the warrant with an accompanying plan of action that requires the warrant serving agents identify the address and the appearance of said building.

While we are at it we should ban civil asset forfeture.

Against. I can’t imagine a case that you have advance knowledge you’re going to need to enter without warning.

It’s an unsafe situation for everyone
