It's his OPINION that it's unconstitutional. His opinion may end up being correct (i.e supported by the courts), but his opinion alone does not make it so.

Nothing stops your city council from passing an ordinance. This just seems to indicate that you can’t issue an edict on Facebook based on feels. Like my idiot mayor did.

I cant say that I'm 100% opposed to Kemps ban. The idea of a cop pulling a gun on a resistant non-mask wearer is the only visual that I need to know that a forced mandate to wear is wrong.
That said, I absolutely agree that I prefer these things to be managed at a city/county level (even if i think the mandates shouldn't happen).

I do find it ridiculous for those claiming that it is unconstitutional for a state to mandate masks. I'm pretty sure that the 10th amendment makes it constitutional for the states (unconstitutional for the federal government). I'm pretty sure that it is constitutional for a state to require a drivers exam, license, seat belt, and speed limit for public safety. I dont see any argument that separates a states ability to regulate a mask any differently in the public square. Hell... isnt it state laws that prohibit smoking in/near private office buildings?

Even though I'm against mask mandates, there is a lot of dumbassery being thrown around message boards and social media.

I went to a wal-mart today, put on a mask to enter, took it off 20 steps later, did my shopping and left without putting it back on, not a word was said to me about it.

Well, he's the state Attorney General, which means he's the main legal advisor to the State government.

So while his opinion doesn't mean it's law, it's a hell of a lot more relevant than, say, yours or mine.

The mayor here in Savannah announced that he will continue enforcing the mask mandate and will challenge the executive order in court.
