They should have waited until ACB was on the bench. She will not be able to take part in this and it's possible for a 4-4 tie.

Doesn’t matter when they request it, just who is on the court at the time the hearing takes place.
Granted, with this being a potential emergency stay, it likely want getting heard with ACB anyway. They need a decision yesterday.

Because the law passed last year, and signed by the current PA governor, says that ballots have to be returned by 8 pm on election day or else they don't count. The PA Supreme Court said screw what the law actually says because covid. I'm sure the court will side with PA, because of Roberts, but it's blatant judicial activism by the PA Supreme Court.

There needs to be some way to deal with these judicial activists who are clearly making rulings outside of the law. If only the Supreme Court could have them removed from the bench.
