Seems like it would be a clear violation of the 5th Amendment.

Do any of the amendments apply to noncitizens?

That would save a hell of a lot of money. Hope we wise up and use the revolving door.

Under Trump’s moronic proposal, an ICE agent could see me on the street shopping in Del Rio, take a dislike to me, ask for my ID, take me into custody for lack of an ID and then dump my arse in Acuna ... leaving me in the position of trying to contact my nearest relative 300 miles away to help me get back into my own country.

Carry an ID, dark little moron....problem solved. Your arguement is stupid.

Wouldn't the non citizen have to be on US Soil to obtain any rights offered by the constitution?

Achtung! May I see your papers?

Let's not emulate Europe.

I flew to Germany a couple weeks ago.

Customs consisted of a sign that said "I have something to claim" with a sign to the right, and "I have nothing to claim" with a sign to the left.

I walked left, and right out of the airport without ever showing my passport to anybody.

It was crazy.

Let it work like any prosecution; if you choose to go to Court and are guilty, and plead guilty...get some slack. If you plead not guilty...and are found guilty...go down big.

A felony conviction should come with a fingerprint ID for future reference. Any and all chance of a Government Subsidy, future Citizenship, or a temp Pass over the Wall, off the table. Period.

The Dems will live or die on this 'hill'. It's their last play...outside of open revolt.

Yea I’m sure you wouldn’t care, under the current rules, if you were arrested and held 20 days until trial when you could prove you were american. That’s no big deal right? Being directly deported is sooo much worse!

This won't hold up, he knows it, he knows the liberals on Monday morning are going to lose their mind about it being a gestapo or something, and completely shift the conversation from what should be done about how we deport people, not if we should. Now this might not be that calculated as his general concept is to just be hyperbolic in the direction he wants, and the results generally favor him. He's muddying the waters, and it generally works for him.

It is NOT a proposal!

William Jefferson Clinton signed into law in 1997, amended 4 times , the last in 2004 under GW Bush.

under the current rules

The "Immigration Agent" (currently called ICE or CBP, but whatever label anyone wants to slap on) has the jurisdiction to confirm/deny citizen/legal status.

Not real hard to confirm John Doe with an accent is who is he says he is. (surfer dude, Bawstonion, New Yawker, Texan, Cajun). Most LEGAL immigrants learn the language and are so proud to be American they carry proof. Since they had to pass the test they probably know more about America than the damned DemProgFilth!

This right here... I don't know what Trumps angle is but the left will be triggered all day tomorrow. He does this every single week and they fall for it every time.

Send them back. They are here illegally. They have no US rights. Finger print, log them and put them on bus back to their country of origin. I would be interested in knowing just how much of our governments money is being spent towards any prosecution of these illegals, along with the cost of taking them into custody, holding them in custody, food, medical care, court costs, etc.

This would free up our courts for US citizen matters.

If they want to immigrate here, they need to do it by following our legal process. Period!

That maybe your opinion but it is totally incorrect from a legal standpoint.

Basically sums up this thread. You said it right on the first page, this would never stand Constitutional muster. There is a whole lot of opinion passed off as fact in this thread, and a whole lot of stupidity.

What if I told you that immigration courts are administrative courts and only do immigration proceedings...

They do when you don’t know if they’re citizens or not. The whole point of the proceeding is to establish that they are NOT citizens or legal residents!

I totally agree. There's no judicial review necessary. Everyone involved knows they're here illegally.

It's about time, illegals do not have the rights that US citizens have in our constitution.

If I’m arrested, I get a phone call and a court date in front of a judge. My phone call means I get a lawyer who can come and show my proof of citizenship to said judge who will then release me. No “arrest”, no trial, and no judge means that I’m already stuck in Mexico without a passport before I even get to make a phone call.

After I get back, that means I sue the government for violating my civil rights and get awarded a metric f$&k ton in damages in civil court.
