You'd also think they would have known this whole "traitor" business and that it would come up. (regardless of your opinion on this administration or any other, they do have an arse ton of smart people working there). They had to have known.

I think he will be subject to the military justice system. He wont' be allowed to walk away free with no consequences. I won't be surprised if he is court marshaled.

Even if the Administration lets him face military justice, they still have to explain the release of the 5 detainess.

That is pretty much it...though I will add to it that it is SPECULATED by some that
- Bergdahl actually assisted the Taliban in fighting the US;
It is NOT speculated that:
- Obama said this morning that the WH had informed congress frequently of this deal being negotiated...a GOP congressman refuted that saying the last they heard was in 2011;
It is Rumored that:
- It is rumored that Bergdahl was never officially designated as MIA because he was a defector.
It is hard to look at what we know and come away with a good feeling on the subject.
Even if you are of the camp that the GITMO detainees were held illegally, that still does not explain Obama's rational is circumventing a law he signed in their release.

Let's put this to rest. Obama signed the defense appropriation bill, one tiny part of which was this requirement. He included a signing statement that he regarded this as unconstitutional and would not abide by it. If you want to know more about signing statements, google Bush and signing statements. Bush made more of them than all previous presidents combined.
