The court-authorized search of former President Donald Trump’s Mar-a-Lago estate is another unmistakable signal that the Justice Department is trying to build a criminal case against him arising out of the Capitol riot.

Ostensibly, the search relates to a long simmering dispute between the former president and the government over Trump’s potentially illegal retention and mishandling of classified information. But don’t be deceived.

I doubt that. The Justice Department well knows that the qualifications for a presidential candidate are set out in the Constitution. They may not be altered by statute, precisely because the Framers did not want the executive branch to be dominated by the legislature, as would happen if Congress could disqualify incumbent or potential presidents simply by passing a law. The Constitution’s qualifications for the presidency are minimal – one must be over 35 and a natural-born citizen. Being a felon is not a disqualification, so even crimes potentially far more serious than mishandling classified information are not a bar to seeking the presidency.

I will if this happens. Statute cannot alter the Constitution.

You thinking of Andrew McCabe notorious FBI weasel?

McCarthy has been a staunch defender of Trump...up until January 6th. Trump's goddamn stupidity that day and this ongoing beef of his with the National Archives served it up to the Democrats on a platter.

Just more unforced errors that he continues to self inflict.

I was going to post that quote.

I hope the Dems are going down this path.

Moreover, the Constitution also prescribes the basis for disqualifying a person from seeking the presidency or other federal office: conviction by the Senate on an impeachment article voted by the House. Again, what is prescribed by the Constitution may not be altered by a mere statute. To trigger disqualification, Congress would have to impeach and convict Trump; it cannot be done by criminal prosecution.

With a Dems House and Senate they may try to go this route before the year end to keep Trump from running.

Oh, please enlighten me. What proven or real stupidity did Trump display? Telling people to go and peacefully protest? Fighting for a stolen election? Please where was his stupidity...

Trump could declassify anything he wanted, they are just trying to make him look bad and set an example to not frick with the alphabet agencies

Trump has been investigated and since the day he announced and they have found nothing. The worst I've seen was the Trump University stuff . 2 impeachment and ongoing show trial a fake Russian dossier they haven't found shite on him in 7 + years .

If what McCarthy is saying is true, ( I suspected the docs were always bullshite) Trump was miscalculating in his dealing with the NA. However if what Lara or Eric Trump were saying were true last night, the lawyers for both sides were trying to hammer the issue out on the remaining documents.

If so that's even more shitty.

Oh, I'm tired of playing with Trump says Biden/ Obama. Find a technicality and let's nail his arse. Trump had some documents that he returned in January....he should not have had them....let's go fishing we search for the boxes .....but we grab everything. Even if we have to return much, we got a looky look

Trump had a bias toward hard copy written communication rather than electronic. That would piss off a millennial trying to inventory the boxes.
