It's going to be very interesting because the President can declare anything unclassified at any time. He doesn't have to go through any "procedure" contrary to what CNN is saying. So one could argue that the mere fact he took possession of them means they were automatically declassified. And if that's the case, then the FBI is sorta spinning their wheels.

Even left-wing Politifact did an article on this years ago when Trump "gave Russia" classified info. (Remember that?). Politifact determined that, yes, the president can do whatever he wants with classified info. And he doesn't have to follow "any procedure" to do it. Lawfare, a left-wing legal blog, agreed with Politifact.

So if Trump waved his hand and said "I, MAGA, hereby declare this unclassified" then it is unclassified. So I wonder what the DoJ's "argument" against that will be. How are they going to argue he didn't declassify them before he took them?

I am not arguing that it is a good thing the president has so much power, but the fact is he does when it comes to classified material. And, actually, it sorta makes sense. If he didn't have that power, then you would have a situation where unelected people controlled classified information and could keep the president out of the loop.
