The argument that the Senate has no duty to advise the president on a nomination is ludicrous. So the Senate has a pocket veto on all presidential nominations? Laughable.
If Obama had any gumption (and/or wasn't almost sure Hillary was going to win anyway), he would have given the Republicans a deadline to bring Garland up for a vote, and, if they failed to do so, have him sworn in. What could the Republicans have done to stop him?

Probably not much. Fortunately, Obama had little to no gumption and was assured that Hillary would win.

No, I'm just saying that it would have been a court blockage and not from anything Congress could have done. I was using semantics based on his question.
