I do know the answer, and it is 'no'.

I wish we had, but, it was by the rules. We had the Senate, we get to bring him up for a vote when we get to it.

You're getting more than 2. Ginsberg, Breyer and Thomas are all ancient.

What turtle McConnell did with the Garland nominee is unprecedented. Refusing to even hold a vote while the president still had a year left before leaving office.
That beautiful ballsy turtle.

The argument that the Senate has no duty to advise the president on a nomination is ludicrous. So the Senate has a pocket veto on all presidential nominations? Laughable.

If Obama had any gumption (and/or wasn't almost sure Hillary was going to win anyway), he would have given the Republicans a deadline to bring Garland up for a vote, and, if they failed to do so, have him sworn in. What could the Republicans have done to stop him?

Is stealing means to beat the Democrats at their own game, the, yes, the seat was stolen.

Let’s not forget where this all began with Democrats blocking nominee, Robert Bork.

Probably not much. Fortunately, Obama had little to no gumption and was assured that Hillary would win.

so violate the Constitution and then hope it doesn't get struck down for it's illegality? what could go wrong?

In a rebuke to President Barack Obama, the Supreme Court struck down three of his recess appointments to the National Labor Relations Board as unconstitutional.

The decision Thursday gives the Senate broad power to thwart future recess appointments, but did not go as far as some conservatives hoped to undercut the president’s ability to fill vacant executive branch posts and judicial slots.

The court ruled 9-0 that Obama’s appointments were unconstitutional because the Senate was not truly in recess when he made them during a three-day break in pro forma meetings of the legislative body.

You should probably go read the relevant text in the Constitution.

I should have clarified; there wasn't much 'Republicans' could have done, as was asked by ridder.

You honestly think Obama would be allowed to seat a SCOTUS Justice without Senate consent?

That's about as gross violation of ConLaw as you can make.

No, I'm just saying that it would have been a court blockage and not from anything Congress could have done. I was using semantics based on his question.
