He says any conviction would be null and void. The Senate cannot try a former president. Roberts knows it is unconstitutional and wants no part in it.

But constitutional scholars, she jack, Nancy, et al, say it’s legal to impeach a president not in office

Yes, everyone is aware of this.
It's all for theatrics.

These folks want Trump in front of a firing squad

He discusses those constitutional scholars.

Kabuki theatre.
Just like the Kavanagh confirmation hearing, the 1st impeachment, the massive show of military force at the Installation Day ceremonies...
100% phony, just like the 2020 election.

XI must have been on daily conference calls with the swamp chewing arse for letting Trump win. Every time I think of Nancy ripping up the State of union address this thought comes to mind.

I hope this impeachment lasts for many months.
It will distract Congress from fricking us all in the arse in other ways.

Indeed! Also I truly think this impeachment will absolutely backfire on the idiot Dems.

I've been reading a lot of European history and I saw a fascinating case that reminds me of impeaching a president who is already gone.
I can't remember the names but some history buff here might recall the case. The old king was overthrown and killed by the new king. This caused the people to think ill of the new king.
So, the new king decided to prove the killing was justified by putting the old king on trial for his crimes.
They exhumed the body and dressed it in old king clothes and put the corpse in court where the trial resulted in a guilty verdict since the old king could not defend himself.
The punishment was to cut off the head of the corpse and put it back in the grave.
Instead of the people being relieved that the new king was not unjust, the people determined that the new king was out of his fricking mind.

Not sure about the case you describe but a pope, I believe Stephen some Roman numeral, put a previous dead pope, Formosus, on trial. Formosus was found guilty and his papacy and all his edicts declared null and void. This was back in the 800s.

That's not the one, but that's a good one.

To be fair, he wants most of them in front of one as well. So then the question becomes which side you think is right.
Left v Right
Divide and conquer
Separate we are weak, together we are strong.

I agree. Let's impeach Obama.

Nope.
Let’s have this impeachment trial and put the MFers on the record.
You can bet Mitt Romney will once again vote to Impeach. Who joins him.

Reminds me a lot of the closing days of the Roman republic where consuls and governors had legal immunity while in office but as soon as they got out of office, their political enemies would bring private prosecutions to exile or even execute them sometimes.
Eventually, when informed this fate awaited him for his arguably illegal actions in Gaul, Julious Caesar after trying to negotiate some immunity or an extension of his office, decided that he was t going to meekly submit himself to his enemies and crossed the Rubicon with his legion.
The same will happen here eventually if this practice continues.

Interesting dilemma maybe? If it is unconstitutional then Roberts would jeopardize himself as a Justice for presiding over an unconstitutional trial.
