Derek Chauvin's attorney seeks dismissal

Greg Joseph, the attorney for Derek Chauvin, spoke with Liz Collin about alleged violations of Minnesota state law by Gov. Tim Walz, Attorney General Keith Ellison, the Hennepin County Attorney, and the court.

Joseph argued that along with violating rights to due process, the charges Chauvin faced were "unsupported by probable cause." Joseph also said that Walz's reassignment of the case to Ellison was "unlawful" —and the failure of the Hennepin County District Court to convene a grand jury violated state and federal rules and laws. 

The petition further argues that these "errors" require "automatic dismissal" of the case against Chauvin for his involvement in the death of George Floyd.

Beyond all the other Walz/Ellison fertilizer, this is just unconscionable and a major misstep.

And if not familiar with Liz Collin, she has done a great job not allowing Chauvin, et al's, injustice to become forgotten.

Yeah, sounds like it has legs, but I can see Dems being ok with this if it gets thrown out prior to a major election

It has.

The appeals court affirmed his conviction. The Minnesota Supreme Court denied hearing the appeal. The US Sup. Ct. denied cert.

He has exhausted his direct appeals and is now pursuing PCR (post-conviction relief). PCR is different in that it requires new facts/evidence not contained in the original trial record.

This is all regarding the state case.

I don't know how any of this would impact his federal charges, which he pleaded guilty to. The plea was entered on two cases, not just the Floyd case but one from earlier. The federal sentence was slightly shorter than his state sentence, so there is that.

He also pleaded guilty along with his wife to multiple counts of tax evasion, but that sentence ran concurrently and has been served.

It was a lynch mob conviction. I hope they're showing the Saint Floyd overdose to every cop in training so they'll see that cellphones and the media can destroy your life.

If he gets out and starts a go fund me, it will crush some souls.

I haven’t seen anything but prison politics differ vastly by region. I can’t imagine it’s been pleasant because he’s LE. But the guards may be sympathetic to him and help him out.

Prison systems often have specialized units for “high profile” prisoners at risk of being targeted by other inmates. For example- LEO. They are often placed
In these protective units for everyone’s benefit. I wouldn’t be surprised if he is in such a unit. Also wouldn’t be surprised if the correctional officers were treating him well.

It was essence the same jury that we see spewing hate and guilty verdicts online in the Nolan Wells tragedy.
