I imagine they would have had to have the insurrection statutes on the books prior to January 6, 2021, also. I doubt the USSC would permit a retroactive statute given the nature of the penalty and Constitutional issues at play.

I haven't read this whole thread but while listening to an expert on Glen Beck a few weeks ago he stated that there was a path.
The house can vote to disqualify Trump and remove him. Then the House would vote on a president. The only candidate they could vote for would be Harris. The only path Republicans would have (if they lose the House) would be to not give them a quorum. there is a deadline for this vote and if they cannot get a quorum to complete then Vance would be appointed President by default.
This would take balls that i am not sure the Republicans have currently.
Hopefully some smarter than me can look up what i referenced.

No, they can’t. SCOTUS already said that Congress has to pass enforcement legislation to utilize the 14th Amendment for these purposes. No legislation was passed.
I get y’all are on edge. The whole country is right now, but if Trump wins the election, he will be your next President (thankfully for the last time).
