So this doesn't change what most employers that I'm aware of do in today's day and age....most have already stopped asking about criminal record on the application.

This still allows you to conduct a background check after the offer with a clean background check condition is issued.

My employees work in schools, schools that require background checks on all of my employees.
Let's say this passes. I now would have to get approval from the government (the school board) to bypass their law for another law OR we just have to take applicants words that they aren't child molesters or traffickers and send them on into a school.
Your government, folks!

No. It’s not. Companies are not running background checks on all applicants. They’re running background checks on people to whom they’ve extended offers.

No, but some of them ask the question early on the application process.

Could be a weed out point by default, as an easy point to disqualify the resume in a pile even if it isn’t an integrity crime like theft or even something relevant to the role.

And if you lie on it, as revealed in the potential background check later, the company (rightly so) will likely withdraw their offer.

Even if the felony is something like forgetting to return a video tape?

And have you never dealt with HR recruiters as a hiring manager? We aren’t just talking about felons here.

They look for ANY REASON to put resumes into the pass pile, and sometimes the reason can be super arbitrary. You get a Puritan one, and the hiring manager never hears about the candidate because of a misdemeanor back in college.

This would expose employers to claims of negligent hiring in cases where someone with a criminal record causes an injury to a customer/random third party.

Sounds like everify but for convicted felons great.... what a bunch of morons. Immigration status and criminal records should be a grounds for denying employment on the spot. Why does this country hate law abiding citizens?

So drivers shouldn't be asked if they have DUIs, for instance? It's just dumb, if people aren't getting called back, there's a damn reason for it, and they would have been filtered out after paying for a background check. Why force companies to waste money and time?
