Joseph Sinawa of Saint Johns County, Florida, is speaking out after a court ordered him to pay child support for a child he claims isn't his. It's not just his word against the child's mother, either -- a DNA test actually proved that Siwana wasn't the father, but the state of Florida is still legally mandating that he hand over nearly a third of his paycheck to the mother of the child.

Sinawa only learned that he wasn't the father of the child after going to the Saint Johns County courthouse to obtain visiting rights.

First Coast News reports that up until last year, Sinawa had believed he was the father and didn't contest it.

"I signed the birth certificate because at the time I believed I was the biological father," he said.

But when he sought further visitation rights through the court, a judge ordered him to take a paternity test -- and the results proved he wasn't biologically related to the child at all.

"I was emotionally devastated," Sinawa shared about learning the child wasn't his to begin with.

This is why you should be able to personally sue a Judge.

I have no patience for this. Innocent men shouldn’t be cutting a check for an unrelated bastard. The mother should’ve had to pay restitution when the DNA results came in

Courts have a hard time undoing consequences of trashy behavior. There are too many missing details. I could see a situation where this would be right.

Sucks for the kid.


The guy should be able to sue the whore for every dime he spent raising someone else's kid if he chose to do so.

You left out the best part...It wasn't even the judge, it was the State that overturned the judge's ruling:

Sinawa explained that the child's mother -- who has not been named publicly -- doesn't want anything to do with him.

"She told the judge she just wants this to be done and over with, and so do I," he said.

The Florida Department of Revenue appealed a decision made by the judge to dismiss Siwana of his responsibility. The reversal meant that Sinawa will have to continue to pay child support.



This guy will get out of this eventually but probably at the cost of 5 years of child support for a kid that isn't his and he will never see again

Don’t sign the birth certificate unless you damn sure..... the cost to undo this will be something, if it can be, till the kid is 18

This is actually not terribly uncommon. Hell, in some states, its the law! IE, if you live as father with the child and then later, figure out you ain't and dump mom...........guess what you'll be paying......

If the individual was denied visitation because of not being the biological father, but then ordered to pay child support... then this is a massive miscarriage of family court justice.

I can see where if the guy gets visitation he should pay child support. I adopted so don't bust my balls about that opinion because I understand being a father to not one, but multiple, children that I did not biologically sire.

But if the man has no visitation rights and is not the bio-dad, but still has to pay, then this is one of the most fricked up things I've heard about in quite a while.

They should just start performing DNA tests at the hospital before any father signs a birth certificate to prevent these kids of injustices from happening.

It'll probably make being a nurse on the newborns floor a whole lot more interesting when they get to see the shitshow that happens when some husband finds out he's not the father.

The Justice ruled in favor of the dad, because the mom stated that she didn't want his money and didn't want him in the baby's life.....

It was overturned by the State Department of Revenue....

yeah some states, like LA, even recognize dual paternity

there are 2 policies behind all this frickery

1st, the "think of the children!" policy. the state rationalizes it by saying, "hey it's not the kid's fault the mom is a slut-whore liar", so fricking an innocent man over is better than fricking the kid over

2nd, the real reason, is the "think of the Medicaid" policy. this is why the State appealed the initial ruling in this case. states will frick over any and everyone to try to recoup Medicaid, which is basically the biggest expense in all 50 state budgets
