Christina Pike’s Execution Halted

Just saw that a federal appeals court halted this execution after the Supreme Court did not. Can any legal eagles explain to me how this is possible?

Women can't be held responsible because,

The Sixth Circuit Court of Appeals stayed the execution shortly before it was scheduled to begin. The court wants further review of issues surrounding whether Pike’s history of childhood sexual abuse, rape and mental-health evidence received adequate consideration in connection with her death sentence.

If the arguments were the same (i.e., the bases for the requested relief) it is not.

Today's Sixth Circuit stay appears to involve another strand of her federal litigation concerning the sentencing record and mitigating evidence—particularly the treatment of her history of severe abuse and mental-health evidence. The Sixth Circuit apparently concluded that it needed time to consider that matter before Tennessee could execute her.

I thought women wanted equality?
It’s really odd how situational that is.

I don't know anything about this case and if she was severely abused that truly does suck. Sounds like she was dealt a shitty hand. But we have a society to run and in our society you do not get to kill people. Period, end of discussion.
The people who want to tell you that it is ok for women to commit murder due to hormones or because said woman was abused are people who want to see our society fail.

Judge Jane Stranch delivered the order of the court.
Judge Karen Moore concurred.
Judge Richard Griffin dissented.
Hmm.

You are guaranteed one habeas petition after a death sentence. To file a second habeas requires jumping through a lot of hurdles that make it next to impossible to actually get it heard.
To get around this - defense attorneys will file what amounts to a second habeas but claim it is a Federal Rule of Civil Procedure Rule 60(b) Motion attacking the original habeas. In this case, the claim is that evidence unknown at the time of the original habeas is now known and impacts the sentence.
The district court dismissed the claim - finding that the petition was really a second habeas. The Court of Appeals found that it could possibly be a FRCP 60(b) motion and should go back down to the district court - either to be heard on the merits or to determine definitively whether it is a second habeas.
Or, to put it more bluntly - the defense threw a hail mary and their prayers were answered

Moore - Clinton

She literally requested to be hanged. She has admitted fault and is ready to die for her crimes.
...yet some lower court is of course going to step in and throw a wrench in the gears. The "justice" system is a complete joke. This woman has been on death row for three decades.

Not just kill. Come up with a plan, beat senseless with two others, torture, maim and eventually kill.

Only when it benefits them. When it doesn't, they prefer special treatement.

I'd be careful taking legal advice from a QB who couldn't fully knock out Jim Rome. ??

It’s been 30 fricking years, that is not a valid excuse. That’s cruel and unusual punishment to the victims remaining relatives that came to see justice finally administered.
She attempted to kill another inmate and was fricking a guard in planning an escape. That’s premeditation and forethought, fry the bitch!

In colonial days, the trial would have lasted one hour and she would have been hanged at 10 days. Our legal system has been turned into a out of touch pachinko game played by the law industry.
