Heck, they already use executive orders to bypass congress anyway. Why not in this instance?

SCOTUS Ruling Dept Navy vs Eagan 1987 clearly gives POTUS the authority to classify or declassify any damn thing he wants.

Ok well. Can a president then sign an executive order informing everyone else that he has to power under law to declassify documents?

What is the formal procedure to declassify? My understanding is that it can be done by the President as simply by declaration. IDK the formalities though.

There’s a simple form he fills out. It’s that simple. It’s a power granted to the president.

Sure he can...but Trump never did before shuttling sensitive documents out of the oval office.

I don’t think he can. He is not a King or dictator. If he wanted to declassify things like where every nuke, sub, satellite, CIA agent, or anything pertaining to national security he would not.

There are things even President’s can’t do, share, or declassify.

But executive orders by their very nature let the president act like a king or dictator by going around congress

is this same question asked 6 times a day in hopes of a better answer?

1. all such sensitive information requires a formal process.
a speech or typing is not enough.

2. the material in question is covered by 4 levels. two of the levels require a committee to review so they can inform many agencies of the change and so that no one person decides.

He didn't have to do anything. Why don't you guys understand this?

quote:

“Mr. Trump had a ‘standing order’ during his presidency that ‘documents removed from the Oval Office and taken to the residence were deemed to be declassified the moment he removed them.’”

Can you please produce documentation of the law that states this?

100% false. Good try, though.

Not according to the supreme court.

The president can at literally any time. And he can make it top secret again I would suppose at any time.

Sorry dog, but the supreme court further says this authority can not be limited by the legislature or other means.

Let's see what happens if this goes to the supreme court. I have a sense I know how this will play out, not because it is a conservative court, but we have a majority who follow the constitution.

I mean in a lot of ways, our President kind of is a bit of both. Ones you like and ones you don’t like.

Only thing is, they are limited to 8 years max in what they can do and can be voted out after 4 if more people don’t like what they’re doing than do - or if some people feel out a way to cheat the voting public.

Unfortunately, the DU and DailyKos crowds have been informed Trump can't do this. Naturally, they then believe it.

Donald Trump, as POTUS, has full authority to declassify anything. The only exception is anything that has been sealed or classified via judge or court, ie FISA. That would require him to solicit the FISA court to remove that seal or classification.
