Curious to see the reaction here if Sullivan calls Van Grack back before him to answer some questions.

How dare you question the Q.

so, DNI Ratcliff said this weekend in an interview that he will be releasing more soon...and that he has been working with Durham.
Tells me that Durham gave him the ok to release this information...so Durham is chugging along.
The prosecutor for this case needs to release that original 302...and if he does...that tells us Durham gave him the OK.

Will any of the released documents vindicate Flynn? Possibly...
I mean...the DOJ dropped the charges against Flynn, the DOJ lawyer Van Grack fled, documents have been released that Flynn didn't lie it was all a set-up...
Yet the DC machine of courts chugs along still...
One step-ahead. Let's say earth-shattering documents are released on the corruption and happens to vindicate Flynn further. Even Barr can't interrupt the precious DC courts.
Sullivan will seemingly stall it further.

Terribly sad for General Flynn. One day he will receive justice.

If all of this is true I can't imagine why DOJ and Flynn's attorneys don't want to hold the hearing for the Judge where they explain why the charges are being dropped. They should be glad to have the hearing.

The problem is he (for extrajudicial reasons) plead guilty.
Legally, no he did not
The judge never took his colloqy, never entered into the record. He has not, to date, plead to anything in the eyes of the law

This is the point I’ve made for months and all the lawyers on the board acted as if the plea didn’t exist. It is obvious the courts are going to uphold the plea and the jail sentence Sullivan imposes, so its time for a pardon(after the election). I don’t blame Barr for this, blame should go to the defense team. They’ve screwed around with this dismissal and even non lawyers knew that wasn’t going anywhere. If I were I were Flynn, I’d can that bunch and get a new team of lawyers.
Then you couldn't be more uninformed about the facts surrounding this case. You're either willfully ignorant, an idiot or a liar.

The problem is he (for extrajudicial reasons) plead guilty. Unfortunately that won't make the case easier because in the eyes of the law you only plead guilty if you actually did it, not because of some other reason.
He plead guilty because he didn't have all the evidence the prosecution had.
That's the problem.

8-2 decision. That's pretty strong. I can't imagine the Supreme Court would touch this case because it doesn't present a compelling national or constitutional issue, but who knows
Obama packed the court with lackeys because if he and his traitors ever got caught, the appeals would go through that court (after coming through the shithead district judges [like Berman and Sullivan]).

so...did the august panel issue any ruling as to the blatant partisanship and bias of the presiding judge?

Federal Judges circling their wagons. Even when they’re wrong, they have each other’s backs.
Disgusting.
Disgusting.

No worries.
The good guys are just letting the bad guys appear to win over and over and over again to make it appear that the good guys aren't in control.
Just keep sitting on your hands and trusting the plan though. Biden's America won't be so bad.

I’m very interested in the next step. Appeal again? I’ve not read the opinion so I don’t know if they discussed Sullivan recusal. Do they let Sullivan have a hearing ASAP and get a ruling.

If you were a lawyer, I wouldn’t have you representing me. You are an idiot because you probably haven’t graduated from Southern yet. You are also very insecure and arrogant.

Appeal again?
perhaps, unlikely
The case has to go back to Sullivan first, Flynn's team will have to see what he does before they can appeal anything.

They did not reassign the case, recusal was not part of the en banc hearing

OK Matlock, why dont you dust off your dentures and argue the points of the case?
Show me where in the record a plea of guilty was entered and accepted?

It was part of the original if I recall.

order to "recuse" - not quite:
Petitioner respectfully requests that this Court order the district court
immediately to (1) grant the Justice Department’s Motion to Dismiss; (2)
vacate its order appointing amicus curiae; and (3) reassign the case to
another district judge as to any further proceedings
-grant the immediate dismissal
-outright reject the amicus
-reassign the case to another judge
Reassigning is embarrassing enough, forcing a judge to recuse himself via mandamus is career-ending.
