If the case goes to trial I wonder who will be sitting at the prosecution's table since the prosecution has asked the charges to be dismissed?? 
ETA: Or will the prosecution's opening statements to the jury be "The government believes the charges against the defendant should be dismissed. The prosecution rests."

No, I'm not. This was a mandamus action. Mandamus would only be appropriate if the action desired was ministerial and the complainant has no other remedy at law. The issue is whether the District Court can hold a hearing to find out why the DOJ wants to drop the charges after a guilty plea has been entered. Mandamus clearly isn't available here.

It isn’t going to trial, Flynn plead guilty. Only avenue is pardon by Trump. This case isn’t being dismissed.

The District Judge could still allow the guilty plea to be withdrawn and the charges dismissed. That ruling hasn't been made yet. Flynn's attorneys are arguing that the District Court can't ask why DOJ wants to withdraw and dismiss after the plea is entered. The propaganda monkeys have no farking clue what they are talking about.

Trump needs to step in. He can pardon Flynn, or he could tell Barr to finally admit in court that the DOJ committed gross prosecutorial misconduct, which was why Flynn pled guilty to a charge the DOJ knew they couldn't prove (lack of materiality). That leaves Sullivan with no room to deny the Motion. The problem is that Barr has yet to allow the DOJ to admit to this gross misconduct. Swamp gonna swamp.

This is such utter bullshite. DOJ has dropped the charges. What case is there to pursue?

This is all about politics. If the case is dismissed that would establish a better environment for the investigation to move forward after the election if Trump wins. The dismissal Wil help establish the fact that he was railroaded. If he has to pardon Flynn the dems and the media will use the argument that Flynn was actually guilty and had to be pardoned.
That is what this is about. Another ploy to sabotage and discredit any and all investigations moving forward. In other words, covering Obama's arse.

Yes, then evidence came to light that he was railroaded. He wanted to change his plea, then the DOJ moved to drop the charges. Judge Sullivan will not accept the charges being dropped. He wants to act as prosecutor now, not judge.

If Trump pardons it stains Flynn from any govt position; because it would be said the almighty court process was not allowed to play-out.

Its political show for the most part, but not very important. Trump wins, the case will be dismissed, Trump loses, a pardon just to make sure it doesn't go anywhere.
