Solid precedent.

quote:

COLORADO SPRINGS, Colo. (The Gazette) - A judge has tossed the case against one of 18 people cited in Colorado Springs after a Black Lives Matter protest on Interstate 25, calling it a violation of her free-speech rights.
El Paso County Court Senior Judge Stephen Sletta on Wednesday dismissed the lone misdemeanor filed against 21-year-old Molly Avion. In a two-page ruling, he found that the state statute used against her — which makes it illegal to obstruct highways — was overly broad in a way that could chill the exercise of the First Amendment and invite “arbitrary” enforcement.

I have a right to travel. No one has the 'right' to block highways.

The right to peaceably assemble is not blocking others from travel. Judge is freaking loony.

So Biden was wrong again when he said that no amendment was absolute.

Not surprised it’s Colorado. Would they feel the same way if republicans blocked the busiest road in Colorado for a week straight? The Republican would be in jail in a heart beat and the judge wouldn’t care .

Interesting article. The law should be applied equally to all who break it.

quote:

In her motion requesting the dismissal, public defender Amanda Bishop cited evidence of what she called selective enforcement. Although Colorado Springs police went to lengths to track them all down after the I-25 protest, they issued no citations to people at “Stop the Steal” protests, who blocked traffic during post-election unrest based on unsupported claims that the election was “stolen” from former President Donald Trump, the motion said.

“By utilizing this statute to charge only Black Lives Matter protestors, the police violated free speech in a content-based way,” Bishop wrote.

This should be appealed.

I understand it is just a misdemeanor charge, but stupidity like this shouldn't be allowed.

Free speech on highways has been stopped before for creating attention grabbing billboards that might be dangerous for drivers.

So this is just liberal lunacy.

If they aren't in a crosswalk I am not legally responsible for what happens next.

It should have been applied equally, but punish the officers that didn't, don't end around.

So then they have the right to block first responders? So I guess people will die on site.

Honk! Honk! Honk!

I suppose the Judge would agree that spreading tacks/nails in his driveway every day would be free speech as well?

Is there even One blue county in Oklahoma?

ETA: Don’t be surprised, most attorneys are left leaning. That’s one reason we have so much wishy washiness in the Republican Party. Too many lawyer politicians.
