So what you are saying is that because she has black skin, she was promoted on a basis other than merit, to the exclusion of "more qualified peers," which can only mean not black.

If the list of qualified candidates tends to be overwhelmingly white, Asian, Jewish, etc and yet black candidates keep coming out on top, the perception is that you either have some genius black candidates or they are getting a little extra help.

Had he just picked her and not come out and said that she would be viewed on her merits as she should be.
100% agreed, when Biden stated he would limit his criteria to only 6.7% of the population, he brought all questions regarding whether this was the best person for the job into play. There will forever be the question regarding this potential(likely) judge as to whether they were the most qualified candidate, or most qualified candidate of a subset of 6.7% of the population.

IF there were a legitimately well qualified perso out there who just happened to be a paraplegic the last thing you’d think of is announcing that you were limiting your search to wheel chair bound candidates.
