I didn’t take it overly as you armchair QB. I just wanted to avoid doing it too much myself.

And the DA who wrote the memo as he recused himself mentioned “mental issues.” I assume there’s something there he’s basing it on.

What law? That a bunch of hicks have the legal right to put shotguns in my face after walking onto a construction site? That is not a justifiable citizen’s arrest.

Two armed rednecks in a pickup cut him off in the street after chasing him around for several minutes. Had they ever told him this was a citizens arrest? Maybe so, but I've not seen that claim

Let's turn this around. If two black dudes jump out of a car wielding weapons while you're on a jog thru their neighborhood, are you going to think "citizen's arrest"?

Well, when trucks keep blocking his path and then rednecks with guns confront you I may understand the confusion.

These guys wanted to intimidate a guy and pushed too far. Their actions and their actions alone resulted in this guy being murdered.

Sounds like you should write a strongly worded letter to a Georgia representative regarding the pitfalls of citizens arrest powers.

Exactly. My first thoughts would be that I’m about to be killed, kidnapped, raped, or a combination of the three, not citizen’s arrest.

Don’t know, we don’t have audio of every interaction, nor does the language of the statute require such a declaration from what I’ve read. I will say, that would be a very useful clarification to add to the statute.

No. Sounds like you also believe this is poor legislation rife with pitfalls, as do I.

ETA: we aren’t sure yet if they will be able to or even need to use it as a defense, at least of a week ago.

Of course he was, you have 3 white witnesses that say it was a citizen's arrest...

Not really good optics but I am certain the McMichael's will testify to such... I don't doubt that that is what they were attempting to do BUT I think their judgement in the situation caused a death and they will end up paying for that...

If they use that defense , they’ll also have to describe in person or immediate knowledge of a felony.

One of the videos shows, what appears to be them, in the driveway one or two houses down of the site where the deceased was trespassing, but we don’t know what they did or didn’t see.

I think cases like this are the unfortunate and unavoidable outcome of such legislation, but regardless it does exist.
