That right there SHOULD be enough for him not to be charged. Break into someone's house... or even attempt to... and you automatically take responsibility for ANY AND ALL consequences that may come your way.

It was a detached garage.

I'm up in Michigan right now - annual deer harvest - and this is big news up here. Everyone is talking about it. A lot of Michiganders are torn.

There's also a big case going on where an Asian shop owner chased a black teen down tge street, who had just robbed his place, and shot him in the back running away.

Guess which case is getting the most coverage?

Well, shooting someone in the back as they are running away seems pretty "open and shut" to a normal person. Not much to discuss.

I'm hearing a lot about the Asian shop owner... I think his stand your ground defense just got smacked down. Then again, that's my neck of the woods.

Prosecutor definitely wouldn't want me on that jury.

This is the advice an NOPD captain gave me.

I fired through the door when someone was breaking into the home. I was afraid I would be overpowered if they made it through the door. They ran away. NOPD told me a did a great job.

If everyone wasted these thieves, then there would be a lot less thievery.

Yeah but that goes to local law. Some places you can defend property, some places you can’t. A detached garage is just property and there’s no reason to fear for life if someone is in there

Once Mr. Homeowner approached his garage, it would be reasonable for him to be in fear.

Whether he knew there were seven in there, he surely would have realized there were more than one or two. Seven yutes burglarizing a place aren't going to be doing so quietly.

Having approached his own garage, he had no duty to retreat, based on the statutes posted in this thread.

?

That is a unit of punctuation, called a "question mark."

It is used to indicate that one is seeking information that one does not yet have.

All depends on what state you’re in. In Texas you can shoot someone robbing your neighbor.

Only place that is acceptable is in Texas. The Castle doctrine.

Nope.

Texas has a provision where its legal to use deadly force to prevent "criminal mischief in the night time."

Castle doctrine does not typically apply if the suspect is only on the curtilage of your property running away.

But if its during the night time in Texas, your more covered if you start blasting away.

Depends on the DA and the judge.
