Some minimal form, yes. That's always been the law.
At the BARE minimum, the accused has due process rights of
1. Notice and opportunity to respond to the claims of the state
2. The state proving they are who the state accuses them of being
3. That you fall within the class of persons subject to the government action

You always argue about what the Dems would do in the inverse. What’s stopping them from opening the floodgates at the border now knowing that we can’t possibly process the amount of people that want in? Don’t tell me we need more judges. You and I both know it’s not practical.

There are already laws on the books, but it is judges that are stopping those laws and executive actions from being effective.
So why pass a new law that some DC circuit judge or a judge in some back water federal district applies a national injunction on the matter. Our problem now is that members of the judiciary who are trying over power the presidency on national security issues.
