I said exactly what I meant. The department and agency head aren’t the proper parties to sue for a Bivens claim alleging excessive force, unless he’s trying to bring a Monell claim, which is exceedingly difficult to prove.

Saw some news headline the other day about ICE using 5 year old kids to draw out illegals - pictures included! The real story is the guy led ICE on a car chase with his kid in the car, abandoned her, literally ran away while flicking the agents off, and then they went to assist the kid.
This is quite literally the goal of the left/media by inciting people, with false narratives, to confront, fight, shoot, attack, block, threaten, etc law enforcement - to make them push back/defend themselves and then scream victims of the nazi gestapo. For example, look how badly you want it :
Constant hostility towards ICE will lead to much more of this and worse. You are succeeding in your mission though, so congrats. Be sure to high five your boyfriend after some more assassins hit their marks, you get the assist on every person killed

Correct. You have to sue the individual agents. There’s no “vicarious” liability for constitutional tort lawsuits because you have to show an intentional violation of a person’s rights by a government official acting under color of law.

Let’s assume for the sake of discussion the court won’t hear this because of that.
His recourse would be to sue individuals?
Or if the court still heard the case, then he would have to prove “intentional“ violation of his rights??
Or do you see the government just settling this?
