Why would you downplay how dangerous this stuff is?
Someone could pump a half-pound of Fentanyl powder into the ventilation system of a packed stadium during a sporting event and kill everyone inside with ease.
But yeah, 23 tons of it, no big deal.

1 - big banks would love the whole bond thing.
2 - a jury of peers is far more appropriate than a panel of judges. Judges can be bought, and often are.

Imagine someone getting ahold of just a couple tons and dumping it in water supply, or dropping it over a city from a crop duster plane

Users of heroin don't really like it, but it's so potent that dealers/suppliers cut the heroin with it to make more money. The end users test it if they're savvy, but most junkies are nowhere near that level of giving a shite.

If the AD wins that case, it will get appealed and the case will be heard by the USSC. It would open up energy, medical and vice companies to similar legal scrutiny and that is not good for those industries. Anything to destroy value and business amirite?
