So here how it works. You access the river at lets say 45ft. You find a place in a willow break and set up in you boat. Duck come in and you start shooting

30 minutes later some arse hat shows screaming at you that you are trespassing you pull out a GPS and explain that you are not and the screaming match starts.

arse hat then pulls out about 300 yards and starts hunter harassment drills. You get piss off and finally leave. When you get to the boat launch some kill m all let god sort it out sheriff deputy is waiting on you because they got your boat numbers and writes you a TP ticket.

You then appear before the circuit court judge who is best friend wit the land owner you then have a choice to make pay an $80 fine or fight it.

It ain't trespassing. These mofos don't own the world. They don't even hunt the deep backwater, hell if anything the po boys on the fringe help the wealthy guys on the interior of the islands (by keeping birds moving, but they're too damn greedy to realize it) But I hope they keep writing tickets because that keeps the crowd thinned out.

Try getting into some backwater hunts on flooded parts of the Ouachita river in NELA.....you will be tickets, firearms seized and in a helluva mess for some time.

GW will write you up with the quickness from the line to Columbia....and they protect the north Monroe money folks..

Why does it matter if the landowner is rich? Idiots were pushing the envelope and got busted trespassing fair and square on both ends.

This is relevant and was just put out by the MDWFP today. Doubt it helps your question but its officers talking about what constitutes public flood waters of mainly the MS river.

The main point they tried to make was about where the navigable stream is and where isn't. They said its sort of grey but if you're duck hunting in "aquatic type plants" then you are probably within the legal navigable stream. Once you find yourself in oak trees then you've probably gone too far and are now trespassing.

Most people think the high bank on the MS side is considered the levee.
This would be an unfounded assumption.

And even if it was factual, what difference would it make? Batture land (like all property) belongs to somebody.

I was out there Saturday morning on my property not far from LMPC. Word is that they handed out 24 citations for trespassing and unlawful possession. As well as one boat that tried to out run the agents P.S. watchout for blackhawk choppers and prop planes

That is a mater of debate and will be settled in SCOTUS eventually.

The current Fed law as I understand it, summarized “ Public ownership of physically navigable rivers including the land up to they ordinary high water mark, pre dates property deeds.

State law does not supersede Fed law does it? And the land we are discussing is covered by water flowing out of the MS river and was under water before it reached its high water mark. Just because the states write laws to protect the land owners right and tries to supersede Fed law does not make them or the landowners right. I did not make them buy the land and they should have known the law before they purchased it.

20 years ago this was not an issue. but now that recreational properties have value every one want to draw the lines.

Until the high court makes a ruling the states are still going to give a ticket no matter how un-justified
it is. Knowing that most will not fight it due to cost and time I got it.

the question you should ask yourself:

"is the land under my boat owned by someone other than the state of Ms or La"

if yes, dont go there

or

"if the river was not high and the land under my boat was dry, would you be deer hunting there without any issues of trespassing"

if no, dont go there
