Selling a portion of 15 acres

My brother, sister and myself inherited 15 acres of vacant land from our father. The 15 acres appraised for about $139,000 or $9266 per acre.
He’s not interested in keeping his 5 acres and wants us to buy him out. He’s been a real prick lately and I’m not really interested in writing him a check for his portion or $46,000.
Can we just have him sale his portion and grant easement to the buyer of his 5 acres?
There is a gravel road with access to property.
Or could I just offer him a low ball offer of say $18,000 and tell him good luck selling it.

If this is Louisiana he can force a partition and have all of the land sold with the profits divided. You can't be forced to remain in co-ownership.

Are the tracts subdivided into 5 acre parcels already or is it one 15 acre tract?

It’s basically 15 acres that’s not subdivided- I’m sure it can be subdivided.
A title guy did just inform me that we could grant access or a servitude to the “new” owner

If it's to be divided equally it'll will end up having same road frontage to make it all of equal value, so an easement shouldn't be needed after dividing.

It'll have to be subdivided unless your brother sells his portion as a 1/3 undivided interest. If he sells that way the new owner will have access to and through every inch of the property.

Get it divided and let him sell. It'll save you headache in the long run.

this makes me think of a line from a movie. "A bronx tale". mob boss basically tells his protege to stop worrying about the $40 he is owed since the guy who owes him is a tool, he basically paid $40 to get him out of his life.

granted $40K is alot more money, but if you can afford it, you can have your brother out of your life for good.

Obviously this depends on the location but offer him $35k but you and your sister keep the property whole (don't subdivide). Either through LLC or trust with you being 2/3 owner. 15acres can be a fun escape of woods, some pasture, and little maintained area. Then if you decide down the road you don't use it enough yall will make more money selling 15 acres than two 5 acre broken tracts.

5acres is just yard work...

Be aware that if he forces it into a Sheriffs Sale then you will have to buy it all or take your 1/3 in cash. There could be 100 or more people bid on it going through the sale.

This the last portion of my dads land that he didn’t sell. We asked him not to save it.
