I want to tell you a story about what happened to me near that dock one day.
I used to live in Newport News
Of all places, the YMCA used to do a byob fundraiser there on Buckroe Beach at the parking lots.
One year they decided to have a midget wrestling tournament for the fundraiser.
One little person showed up and we all paid fifty dollars to watch it. Crowd was getting pissed.
Quick thinking folks decided to have the little person referee two mildly hot girls. They bought a baby pool and rushed to get a bunch of astroglide. Granted I was 26 so everything was hot then.
Girls wrestled in it in their panties and bras…..and it was beyond entertaining.
I did not have a camera and cellphones weren’t a thing back then.

I've seen more and more of this behavior lately, and I just don't get it. I was raised on a lake. My inlaws live on a lake now. It's so normal for people to fish your dock/wall/riprap whatever on your lake front. Why the hell wouldn't they? I just don't understand where this weird misconception comes from that you have the right to tell people to get away from your dock.
Also: I don't get why it irritates dock owners so badly? Are they gatekeeping their honey hole or do they just not like seeing people in boats? It's so weird. If I'm on the dock at my inlaws messing around and a fishing boat trolls by, I'll always ask them something like "hows the fishing today?" Just bizarre that people have gotten so hostile toward others. And no.. it's not about race, even though this video was... I've seen plenty of videos with white folks doing the same shite (albeit, not pulling a gun).

Retired boomers. Full of themselves with nothing going on in their lives since they ran off their kids and get pissed about the strangest things.
In my parent's neighborhood they have a big war about who cut their grass the most recent and so they all end up cutting their grass way too often multiple times a week. Someone bought a lot across from my parents that blocked their view of the mountains a bit and had to hear them complain about that shite for like 2 years.

When i see fishermen around our dock and boathouse, I point out promising spots that hold bass.
If they catch a goodun, more power to them.

In most states, the bottom can be privately owned but the water is public (excluding something like a landlocked pond). So someone in a boat would be perfectly legal as long as they didn't drop anchor, since the bottom is her land but the water is public.
This isn't applicable in Louisiana though as we have some screwy public / private waterways laws.

Depending on where its at, some local governments will issue permits to waterfront property owners to build a dock from their property a certain distance over the public waterway. But the property owner only owns the dock and they have no ownership of the water or land below it. Boater would only be trespassing if they got onto the dock or tied off to it.

I will never understand why people give a shite about others fishing around their docks. I have a lake house and whenever someone is fishing around the pier I just shoot the shite with them. How does fishing bother anyone to the point they'd pull a gun?

Generally, but this doesn’t seem to rise to that level. She’s on her own property and thought something was happening. I’d vote not guilty on that. Similar case with worse facts in EBR the Jury acquitted the lady. Somewhat well known case that a judge got in some trouble over.
If she pointed it at them in a menacing way (not just accidental gesturing) then you could jump to aggravated assault. That may plead down to a brandishing if so.
Definitely not smart on their part to confront the fisherman.

Louisiana is the only state in the union that allows tidal water to be owned.
Finding oil and gas has made it more convoluted.
The rule is…
Water bodies that were navigable in 1812, when the state of Louisiana was admitted into the Union, and continue to be navigable are public things (See La. Civ. Code art. 450). Conversely, water bodies that were non-navigable in 1812 and continue to be non-navigable are private things. Questions then arise as to the status of water bodies that have become navigable or ceased to be navigable after 1812 (See 2 La. Civ. L. Treatise, Property § 4:2 (5th ed.)). Since the state (in its public capacity) generally owns only navigable bodies of water and non-navigable waterbodies are privately owned, resolution of many of the issues raised in this regard hinge on navigability. Generally speaking, a body of water is navigable in law if it is navigable in fact, and a body of water is navigable in fact if it is capable of being used for commercial purposes over which trade and travel are or may be conducted in the customary modes of trade and travel (See Walker Lands, Inc. v. E. Carroll Par. Police Jury, 38,376 (La. App. 2 Cir. 4/14/04), 871 So. 2d 1258, writ denied, 2004-1421 (La. 6/3/05), 903 So. 2d 442; and Ramsey River Rd. Prop. Owners arse’n, Inc. v. Not justifying their behavior at all but i can see it being aggravating if you had kids or grandkids that would swim at the dock and their were a ton of lure's, hooks and fishing line hung up off every part of the dock. Again not saying that pulling a gun on someone fishing is justified at all but thats one of the few things i can imagine would be aggravating if you owned that dock. That being said these fisherman and boat operators are always filming so you better get with the times or you will be made a viral fool nearly every time you pull that move.
