This. The way the OP tells it, there was no offer of a refund of the deposit, and it's mentioned that the check was cashed, all indicating his belief that getting the deposit back was not an option. Which, if true, is BS. The purpose of the deposit is to guarantee the guide that his time will be covered that day, if the client flakes out. They no longer have an appointment set, so the deposit is no longer needed.
