That's if you buy it that way. If you form 1, it's $200. At least that's the way I understand it.

to be fair, we haven't heard anything from the ATF, yet. i wouldn't do anything until we do.

Yea there’s zero reason to build your own AOW. You might as well form 1 a SBR or SBS because it’s still going to cost $200 to make an AOW on a form 1 but you still can’t put a stock on it. An AOW only makes sense if you’re buying it already built on a form 4 because then the stamp only costs $5.

They won't notify anyone. They refused to specify what qualifies as a brace previously.
It's going to be another one of those laws that they will use against you if they ever want to.

This is what Q sent to their customers when the ATF shut their pistol down.
Complete one of the following:
Remove the barreled upper receiver from the lower receiver and dedicate it as a replacement
for another AR-style pistol or registered short-barreled rifle; or
If you do not possess another AR-style pistol or registered short-barreled rifle, remove the barreled upper receiver from the lower receiver and temporarily transfer it out of your possession by, for example, transferring it to the dominion and control of another individual; and
Once the previous step is completed, you may file an ATF Form 1 to register the lower receiver as a short-barreled rifle. Upon Form 1 approval, the firearm may be reassembled.

If this goes into affect and assuming I built a braced pistol from a stripped lower, can I just purchase a 16" upper and a stock and no longer be in violation of NFA?
Was looking at multiple uppers anyway.

Yes. You can always turn a pistol into a rifle by either installing a 16”+ barrel or have a barrel extension/ muzzle device permanently attached that brings the barrel length up to 16”+.
So yea you could put a rifle length upper on a pistol lower and be good to go even with adding a stock. The only thing you could get in trouble for is if an ATF agent was ever really pissed off at you for some reason they could try to nail you for “constructive intent” if you still had the pistol upper and a rifle lower in your house, even if they weren’t assembled together at the time.

Thanks, complete uppers are not serialized correct? Seems like it would take the ATF a lot of work to determine those that had purchased pistol length uppers. All of this for something that in home defense situations is causing no harm.

The atf had already issued a statement saying that even if someone was shooting the brace from the shoulder it wasn’t an issue as long as they aren’t modifying the brace.

Once again the ATF makes no sense in their "rulings". While it looks like the majority of AR Pistol owners are safe for now, I have no doubt the ATF will soon make their next interpretation for domestic firearms.

Of course they will. There is no logical reason to make a distinction between import and domestic braced pistols if this is not the end goal.
