That I don't have the right to deny him access to this property, and there's obviously more to it. I did have a consultation with an attorney and he stated this is a massive stretch on his part, but no one wants to deal with this nonsense. I just want to make sure I comply with the requirements of the discovery request. I also don't want to go into too much detail on a public forum.

Problem, as is posted below, the timber company can just pull the lease. I have a call in to them now to see if I can just hand off the lease to someone else. The members really need to tell this guy to kick rocks, they just don't want to deal with him either. I'll get through discovery with a lawyer and maybe represent myself.

Really you should get a lawyer and have him file for a motion to dismiss before you even go through discovery.

Their case is weak, so they’re using the discovery process as a fishing expedition hoping to dig up anything they can use against you.

Solid advice, and will ask the attorney to do this when we talk later. They really have no case.

I feel bad for OP but representing yourself is a terrible idea. I am not licensed to practice in Louisiana so this is just friendly advice, but:

1. GET A LAWYER. Call five more. NEVER REPRESENT YOURSELF.
2. Ask that lawyer how to quit the club. It's likely that if you are no longer an agent of the club if you quit. Once you are no longer an agent of the club, you are no longer on the hot seat. Let the other members deal with this. One way they can deal with this is to dissolve the entire club and drop the lease. Verify all this with your lawyer that is licensed to practice in your state.

We had a country club debacle a few years back where a man and woman were caught canoodling on a couch, but the were both otherwise married. The house committee told them that if they both resigned immediately, it was no longer a club matter and the club could not pursue it. Be that immediate resignation (pending advice of counsel) and make yourself no longer a club matter.

Thanks for the advice. I won’t represent myself. I’m going to ask for the dismissal, slow walk it till next year if I have to, then just change the lessee to something else.

UPDATE

One of the paying members called and said he would get out if we found a member that would pay him back for the year. I made the plaintiff an offer for his son to get in the club, and give him full access so long as I could deal with the son, and not him. He had his lawyer tell me to kick rocks, in so many words. He stated he had the support of the members. Once the members got wind of this they wanted a meeting called. They voted him out 6 votes, 3 abstains, and his vote was the only stay vote. It remains to be seen what he will do with his suit, I've asked for a full voluntary dismissal.

Looking back on this 23 year drama, especially the last 3 years, he genuinely believed the members fully supported him. He never understood that they just tolerated him. I tried to tell him I had to barter peace for him 3 years ago, and he refused to accept this. His neighbor called me this morning and told me he was incredibly humbled about the outcome of the meeting last night. I hate it for the guy, he was offered everything he wanted and truly lives in a reality all his own.

My experience with people like this is he will quickly re-imagine a different reality and get over it. Probably a new reality where everyone in that club is stupid and mad of his excellent hunting skills.

This club sounds like a bunch of stiffs. If you can’t get drunk and throw some locker room talk around, I wouldn’t want to be a member of the club. The point is to have fun and enjoy the outdoors. I’ve seen many clubs ruined by club presidents who act like they are running some kind of Fortune 500 company.
