Media mogul Byron Allen is threatening legal action against major brands if they don’t allocate more ad dollars to Black-owned media.

Allen sent letters of intent to brands and their agencies last week calling on them to shift a minimum of 2% of their budgets to Black-owned media or face legal action.

Over the past year, Allen, who owns The Weather Channel, as well as seven other cable networks, a syndication production company, local stations and digital assets, says he has engaged in conversations with chairpeople and CEOs at agencies and holding companies as well as brands about investing more in Black-owned media. But one year later, Allen says he has not seen any real progress.

Allen calls out General Motors and Coca-Cola as two brands that have a poor track record of working with Black-owned media and companies he has sent letters to asking for change.

He has previously successfully sued Comcast and Charter.

In 2020, Allen ended a 5-year campaign against Comcast. After reaching the Supreme Court of the United States, Allen settled a $20 billion legal claim (for racism), achieving carriage agreements for three of his cable channels: Comedy.TV, Recipe.TV, and JusticeCentral.TV.[6]

If they had any balls, they'd both tell him they're pulling all advertising from any channel owned by Byron Allen in response to his hostility and threats of legal action.

But we all know they'll bend the knee and quadruple their ad buying

What law requires a company to spend money at one media firm over another?

But the Supreme Court struck down many of Allen’s arguments last year. Allen’s case was legally significant because it relied on the historic Civil Rights Act of 1866. Enacted a year after the Civil War ended, the law mandated that Black citizens “shall have the same right ... to make and enforce contracts ... as is enjoyed by white citizens.”

In a 9-0 decision in March 2020, the high court said it was not enough for a civil rights plaintiff to assert that his race was one of several factors that motivated a company to refuse to do business with him. Instead, the person must show race was the crucial and deciding factor.
Comcast settled its portion of the lawsuit with Allen last summer, agreeing to carry three of his TV channels on Comcast’s Xfinity system.

Both Philadelphia-based Comcast and Charter, which is headquartered in Stamford, Conn., had denied that they discriminated against Allen because of his race.

Terms of the Charter settlement were not disclosed. Late Wednesday, Allen’s company and Charter released a brief joint statement: “Byron Allen’s Entertainment Studios Networks has resolved and withdrawn the lawsuit against Charter Communications.”

Both sides declined to comment further. A spokesman for Allen declined an interview request.

So is he responsible for restricting features on that app so they could start charging a premium for them?

these companies settle, because paying the lawyer tabs are just as bad as just buying him off.

No law. Just like no law requires a business to spend any money at all advertising if they don't want to. Or all of it at one station if that's what they want. This is simply about shaming businesses into doing what he wants, and if they don't cave he'll attempt to force them into compliance by calling them racist. It's extortion.

This is no different than him walking up to your home and asking how much money you personally spend at black owned businesses and telling you if you don't increase it he'll sue you.

Lunacy.

Burden of proof will be on them to show they offer access to comparable market segments and that prices are comparable. If companies are getting cheaper costs per interaction/view and have better access to target market segments with their current agreements- then there is zero standing.

Could it be, GM and Coca-Cola would decide to move forward with media companies who are the most qualified to promote their products?

And yet you have white American males cheering it on and actively voting for it.

I can't stand the stupidity.
