Take for instance, weed get legalized. Yet the boss don't want them to smoke marijuana on the job.

Would that be grounds for Marijuana smokers to file an action against their bosses for discriminating against Marijuana smokers?

Cigarette smokers can take smoke breaks and smoke on the job, why wouldn't Marijuana smoker do the same?

Just claim it is for religious reasons. You cannot be terminated based on religious principles.

No - because it is an impairing drug. Alcohol is legal, but most companies don't allow you to be legally drunk on the job.

well since cigarettes don't impair you, then I doubt it would go anywhere.

It would be treated the same as alcohol and there are no alcohol breaks at work.

No. Does your boss let you drink alcohol on the job even though its a legal intoxicating substance?

Does your boss allow you to drink alcohol on the job? Do you go into work drunk? Would you file an action against your boss for firing you for getting hammered on the job?

ETA: OP did not think this one through before hitting submit.

It will never get decriminalized in the south because marijuana is against Jesus and next thing you know, we'll all be worshipin' the devil. Roll damn Tide, Pawl.

It should be legal but that is the biggest hurdle. How high is too high for work? We need a test similar to blood/alcohol level. Because right now it's just "has this person smoked in the last 6 months? Pass/fail"

Yes, because smoking a Camel is the same as smoking a joint.
