Isn't it illegal to have to disclose your personal medical records to your employer?

Can't we all just tell our employers , " Yea Im Vaccinated" and that be as far as they can tread?

No, not in the case of vaccinated or not.

My neighbor's buddy said you just gotta plead the 5th. Then tell them HIPAA. Report back to us how it worked out

Oh just get vaccinated it’s not that big of a deal. You’ll only need to go every 8 months or so. Don’t worry about long term affects when there is a very lethal virus out there killing many of our old and fat.

In a broad stroke no. There are exceptions but not where you are headed.

Not if they require confirmation.

You can refuse to provide that information to your employer.

They can either accept that and treat you as unvaxxed and require you submit to the periodic tests (if the DoL bullshite doesn't get shot down)..... or they can shitcan you for non-compliance depending on their vax policy.

If you opt for the medical/religious exemption that would be all the proof they need to shitcan you in employment-at-will states.

personally i like the civil-disobedience/refuse to comply routes.

I don’t know, I’m routinely required to show proof of MMR titers, recent TB test, etc. I work in healthcare though.

Every year during open enrollment, I have to sign an affidavit saying I'm tobacco free. If I refuse to sign, I pay a higher rate for insurance. If I lie and sign it and something comes up health related that can be attributed from tobacco use, I'm sure the insurance will fight me over paying my claims. I can see this work vaccine issue going along this same route.

Generally, the Privacy Rule applies to the disclosures made by your health care provider, not the questions your employer may ask.

It’s not illegal if they ask and you consent… if they ask and you say none of your business that’s a different story… if they find out or look into your medical history without your consent then that is illegal
