In some states, wouldn’t be too late to sue?

Did Disney pick up the tab when she was taken to the hospital after the incident?

Also, the incident was four years ago, imagine the pain in the arse of trying to find witnesses and getting accurate statements from them in an age where people can’t remember yesterday accurately.

Good thing she is only asking for 50k, Disney may just write a check instead of fighting it. It would cost more to defend the case in legal fees than just paying her off.

She was taken to a hospital and was treated by a specialist for the injuries, ultimately suffering severe lacerations, damage to her internal organs, and a hernia, according to the lawsuit.

That’s not nothing.

Your wife lost her top. This woman was hospitalized. But sure, same thing.

The lawsuit accuses Disney of negligence for not warning riders about the risks of the waterslide and not informing riders about proper protective swimwear.
As if this would have made a bit of difference. This is yet another leech trying to game the system.

Florida has a four year statute of limitations.

Disney doesn’t have medical payments coverage and doesn’t pay for medical treatment for guests.

The biggest fight is going to be liability and whether Disney did anything wrong. The facts are pretty much well established.

They are suing for a minimum of 50k, which is the amount necessary to invoke the jurisdiction of the circuit civil court. Likely going to want six or seven figures to settle.

The woman in the OP had significant internal damages requiring hospitalization. Not just a little embarrassment

Hundreds of thousands have ridden this ride over the span of decades.

How does somebody get injured in such a well tested ride?

We’re talking Disney here. Hyper focused on safety to protect their empire from lawsuits too.

Was coming to say this. The claim has probably been in process for a while with Disney largely ignoring it because its dumb, but the attorney had to actually file suit to interrupt the statute of limitations.

She had actual injuries including a hernia and is suing one of the largest corporations in the world (2nd largest media company and 87th largest company) for only 50K. That doesn't sound like a leach to me.

She isn't suing for just 50k, that's the minimum. How many thousands have ridden this slide without this happening to them? Something is fricky here.
